BuyCheck AI Terms of Use

1. What BuyCheck AI is

BuyCheck AI is a consumer shopping intelligence product. It uses AI to help you find gifts, evaluate products, track prices, and schedule reminders. Outputs include suggestions, verdicts, scores, and reasoning generated automatically by AI models in response to your inputs.

2. Eligibility

You must be at least 13 years old (or 16 in the EEA) to use the Service. If you use the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms.

3. AI outputs are informational, not advice

BuyCheck AI’s recommendations and verdicts are informational and provided on an “as is” basis. They are generated by AI models that can be wrong, out of date, or inconsistent. We do not guarantee that a product will be a good gift, that a price is the lowest, that a return policy will be honored, or that a seller will deliver. Always verify pricing, availability, and return policies on the retailer’s site before purchasing.

Nothing in the Service constitutes legal, financial, medical, or investment advice.

4. Affiliate disclosure

When you click through to a retailer from BuyCheck AI, we may receive a small commission if you make a purchase. We use symmetric affiliate rates: our rankings and verdicts are not influenced by which retailer pays us more. We publish our methodology and the categories where we are paid in our transparency report.

5. Your account and content

You are responsible for the information you submit to the Service, including product URLs, descriptions of recipients, and feedback. You represent that the content you submit does not infringe any third party’s rights and complies with our Acceptable Use Policy.

You retain ownership of the content you submit. You grant Sonare a worldwide, non-exclusive, royalty-free license to use that content to operate, maintain, and improve the Service, including using aggregated or de-identified data to improve our AI models, as described in the Privacy Policy.

6. Purchases happen at retailers

BuyCheck AI does not sell products directly. All purchases occur at the retailer’s site under the retailer’s terms. Disputes about a purchase, refund, return, shipping, or product quality are between you and the retailer. Where we have referred you to a retailer with a verified return window or cancellation policy, we will help you understand those policies, but we are not a party to the transaction.

7. Experiences as gifts

When the Service recommends an experience(e.g., a class, tasting, tour, or activity), the recommendation is governed by the experience provider’s booking, change, and cancellation terms. Experiences are typically not returnableafter the scheduled date and frequently have cancellation windows shorter than physical-product return windows. We will surface the provider’s cancellation policy where available, but the provider’s terms control.

8. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy. We may suspend or terminate accounts that violate that policy.

9. Intellectual property

The Service, including its software, design, text, and AI models, is owned by Sonare LLC and its licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service. You may not copy, modify, distribute, sell, lease, or reverse-engineer any part of the Service, except as permitted by law.

10. Termination

You may stop using the Service at any time and may delete your account from your profile or by contacting support@buycheckai.com. We may suspend or terminate access if you violate these Terms or if continued operation would cause us to violate the law.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR ACCURATE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SONARE LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THAT PERIOD AND (B) US $50.

13. Indemnification

You agree to indemnify and hold harmless Sonare LLC from any claims, damages, or expenses arising from (a) your use of the Service in violation of these Terms, (b) content you submit, or (c) your violation of any third-party right or applicable law.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Nothing in these Terms prevents you from filing complaints with any applicable consumer protection authority.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date above. Material changes will be communicated in the app or by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
